About Dance and Shop

Dance and Shop is a trading style of International Dance Supplies Ltd (IDS) a company registered in England with registered number 05452207.  Our trading address and registered office is at Harlequin House, Forde Court, Newton Abbot, Devon, TQ12 4BT United Kingdom.  IDS are a long-established supplier of dancewear and accessories to UK and International customers. We are one of the world’s largest suppliers to dance teachers and dance schools; and through this Dance and Shop website (www.danceandshop.com) we also supply the students of our dance teachers and schools directly.  We are approved suppliers to a number of recognised dance and examining bodies in different countries and manufacture clothing for certain bodies under licence.

Please note, IDS operate four distinct websites:  ids.co.uk (dance teacher/shops trade only), idsdance.com (USA dance teacher/shops/schools trade only), idsshop.co.uk (retail for dance students of IDS trade customers) and danceandshop.com (retail for dance students, USA and internationally). If you are a dance teacher or dance school please go to ids.co.uk or idsdance.com (United States) to benefit from our bulk trade pricing.

Hours

Our website is available 24 hours a day, 7 days a week, with real time stock availability. Please note we do not currently take postal or telephone orders from dance students. If you are unable to place a web order please ask your dance teacher or school to order on your behalf.

Ordering

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these Terms and Conditions you should contact us by email before placing an order using the contact form or contact details below.

Stock Availability and Order Acceptance

During the registration process, you must provide your email address and set up a password which can be used for future ordering. If there are any changes to the details supplied by you it is your responsibility to inform Dance and Shop as soon as possible.

All orders are subject to acceptance and product availability. Availability information for products is listed on each individual product’s description. If we do not have sufficient stock to deliver immediately you will be given the option of us emailing you when the item becomes available. Orders are only despatched Monday to Friday.

A confirmation email will be sent to the email address given in your order form and will detail products ordered, payment method, cost (including delivery/postage). No contract for the sale of any product will exist between you and danceandshop.com until we accept your order by despatching the product to you.

Payment

We accept the following cards: Visa, MasterCard, Delta, Electron, Amex or Maestro. US Dollar payments require Visa, MasterCard or American Express. Dance and Shop does not accept cheques; no credit accounts are available. If you are a dance teacher or school please use our trade site at ids.co.uk or idsdance.com (United States). We pre-authorise your card online and will only charge your credit or debit card when the order is ready to be despatched.  All payments will be taken by International Dance Supplies Ltd.

All credit and debit cardholders are subject to validation checks and pre-authorisation by the card issuer online. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Delivery/Postage

Delivery will be charged at the rate set out on the website which may vary from time to time. The total amount including delivery/postage will appear in your dance bag prior to you accepting your order. Please note that we do not refund the delivery/postage element if you return goods to us which are not faulty.

Deliveries will only be made to the cardholder’s address.

Exchange Policy

Dance and Shop will be happy to exchange for the same item any product that is damaged, faulty or incorrectly shipped through any circumstance that is attributable to IDS provided the product is returned to us within 28 days from the date of despatch.

Returns

Union Jack FlagIf you are a consumer, we are pleased to offer a no quibble 14 day returns guarantee. You have a legal right to cancel the contract within 14 working days from the date of invoice for any reason. This cancellation right does not apply in the case of the exclusions set out below you must give us notice in writing within this period and return the goods within 14 days from the date you receive the goods.  Unless the          
          products are faulty or not as described, you will be responsible for the cost of returning the products to us.

US FlagWe are pleased to offer a no quibble 28 day returns guarantee. Simply return your items within 28 days of date of invoice for any
          reason for a full refund. If any custom charges or taxes have been paid, these will not be refunded to you.

All of our garments are scrutinised prior to despatch but should be checked before use as we do not accept returns on worn clothing, unless a fault has quickly revealed itself after initial wear. In such isolated cases the garments need to be washed before return. Please use the returns note which is printed on the reverse of the picking slip enclosed with your parcel. Please mark faults with sticky tape to identify the problem. A receipt of postage should be obtained for all returned items and the cost of return postage will not be refunded.

Please note that garments which are not regular stock items, i.e. personalised print garments, will not be accepted back for credit. For reasons of hygiene we are unable to exchange or credit hats, wigs or underwear even if returned unworn. Tights may not be returned once opened unless they are faulty. CDs, DVDs are also non-returnable. Clearance and sale items are non-returnable unless faulty.

Parcels being returned from outside the UK must be clearly marked on the box as ‘Goods being returned to the UK’.  Any customs charges incurred by IDS due to a parcel not being clearly marked will be passed on to the customer and deducted from the corresponding credit.

Refunds will be credited to the credit or debit card used for the original purchase as soon as possible, in any case within 30 calendar days.  This does not affect your statutory rights as a consumer.

If you return the purchase(s) to us for any reason, you will have to meet the postal or other costs that you incur in doing so yourself.  The return address is set out below.

If you are returning an item from the United States please complete a contact form and provide us with your details so we can make contact with you about your return.

Conformity of Goods

Every care is taken to ensure that the specification and description of our products are correct at the time of going to press. However, descriptions and specifications of products on this website are not intended to be binding and are only to give a general description of the products. Colour reproduction of the products is a close representation. However, we cannot accept any responsibility for any variation in colour caused by the browser software, monitor or computer system used by you. All our products are intended for children aged 3 years or above.

Data Protection

When you place orders they are recorded on our secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, as required by the UK Data Protection Acts of 1984 and 1998, we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorized access. Dance and Shop will not sell or pass on your details to third parties unless required for the purpose of fulfilling your order.

Our security procedures mean that we may occasionally request proof of identity before we are able to disclose sensitive information to you. We have taken every measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers.

Retention to Title

The Property and title, both legal and equitable in any merchandise sold or agreed to be sold by Dance and Shop will not pass to you until all sums due to Dance and Shop have been paid in full.

Indemnity

You agree to indemnify, defend and hold harmless Dance and Shop, our officers, employees, consultants and affiliates, from any and all third party claims, liability, damages and costs, including but not limited to legal fees, arising from your use of this website or your breach of the Terms and Conditions.

Liability

The maximum liability of Dance and Shop to you under contract tort or otherwise for any loss whether direct or indirect is limited to the price of the products purchased to the maximum extent permitted by law. Nothing in these terms affects your statutory rights as a consumer.

We do not accept liability for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice. Dance and Shop shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products. This does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights. Nothing in these terms and conditions (whether or not under the heading of Liability) shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Mistake

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price. In the event that you order an item and the price published on danceandshop.com is incorrect for any reason, we will email you to inform you that we have not accepted your order, and that your order has been cancelled. You will be advised of the correct price of the subject product.

You may re-order it if you wish. If you have already paid for the goods, we shall refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be posted to your credit card.

Personal Use

The products sold on danceandshop.com are provided for private, domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of, or for any products or services purchased from danceandshop.com.

Intellectual Property

All materials within the Dance and Shop site, including photography, images, site design, text, graphics, software compilations, underlying source code, software (including applets) are the intellectual property of International Dance Supplies Ltd or its licensor.
